4. Setting up the service
Setting up the service begins after:
- settlement of the first payment or of the applicable subscription;
- receipt by Gustosia of all the information, content and materials needed for the configuration.
Gustosia creates the Customer’s account and carries out the initial configuration of their space.
The login details are then sent to the Customer, who can change their password at any time.
Setup includes in particular the configuration of the menu or guide, the customisation provided for in the plan subscribed to and the generation of the corresponding QR code(s).
The materials needed for setup must be provided by the Customer in a usable format.
5. Information and content provided by the Customer
The Customer undertakes to provide Gustosia with all the information needed to create and configure their space.
For a restaurant, bar, brasserie, café or similar establishment, these materials may include in particular:
- name of the establishment;

For hotel establishments, the Customer also provides, where relevant and available, links to their website and booking website, in order to facilitate the collection and verification of the information needed to configure the guest guide.
Providing these links does not relieve the Customer of the obligation to check the accuracy and currency of the information published in their guide.
The Customer is responsible for the accuracy, currency and lawfulness of the information they provide.
In particular, it is the Customer’s responsibility to check the accuracy of the prices, opening hours, allergens, ingredients, availability and other information communicated to their own customers.
Gustosia cannot be held responsible for the consequences of incorrect, incomplete or out-of-date information provided by the Customer.
6. Customisation and changes
The initial graphic customisation of the menu or guide is carried out by Gustosia in accordance with the plan subscribed to and the materials provided by the Customer.
The Customer then has access to their management area, allowing them to edit the content provided for by the service’s features.
Content changes made from the back office are included in the subscription and can be made by the Customer without any particular limit, subject to the features available in their plan.
Certain changes remain reserved to Gustosia, in particular:
- changing the overall visual identity;
- creating or changing certain structural settings;
- adding new outlets in the hotel plans where this requires action by Gustosia.
These interventions may be discussed with the Customer beforehand.
7. QR codes and access to the service
Gustosia generates the QR codes needed to access the menu or guide as part of the plan subscribed to.
The Customer can access their QR codes from their back office.
Access by short code may also be available, depending on the plan’s features.
The Customer is responsible for installing, displaying and looking after their physical media bearing the QR codes.
8. Prices and VAT
The applicable prices are those indicated by Gustosia at the time of subscription.
Subscriptions are invoiced monthly according to the chosen plan:
- Restaurant, Bar, Brasserie, Café and Nightlife Venue Plan: €39 / month;
- Hotel Plan: €79 / month;
- Hotel Multi-Service Plan: €119 / month.
The setup fees applicable to the hotel plans are invoiced in addition to the subscription.
Any discount, launch offer or special pricing condition applies only for its own duration and under its own conditions.
For as long as Gustosia benefits from the French VAT exemption scheme for small businesses (franchise en base de TVA), VAT is not applicable. Invoices then bear the legal statement corresponding to the applicable tax regime, in particular “TVA non applicable, article 293 B du CGI” (VAT not applicable, Article 293 B of the French General Tax Code), for as long as this statement remains applicable.
Gustosia reserves the right to change its prices for new subscriptions. Any price change applicable to an ongoing subscription will be communicated to the Customer within a reasonable period before it takes effect.
9. Payment and renewal
Subscriptions are paid via Stripe.
The subscription is taken out with no minimum term and is renewed automatically each month, unless terminated by the Customer or by Gustosia under the conditions set out in these T&Cs.
The Customer authorises Stripe to collect the payments due under their subscription.
Setup fees, where applicable, are due when the service starts.
10. Termination
The subscription is taken out with no minimum term.
The Customer may request the termination of their subscription at any time, either by using the cancellation feature made available to them in their payment management area, where this feature is available, or by sending a request by email to contact@gustosia.com.
Any request received by email is processed by Gustosia. The Customer receives confirmation that their request has been acknowledged.
Termination takes effect at the end of the monthly period already paid for. No further subscription payment is to be collected from the following monthly period onwards, provided that the termination has been recorded in accordance with the applicable procedure.
Any month that has started remains payable and is not refunded, even where the Customer requests termination before the end of the period concerned.
Until the effective date of termination, the Customer retains access to the service under the terms of their subscription. From that date, access to the service may be deactivated.
11. Late payment or non-payment
In the event of non-payment or failed payment, Gustosia may contact the Customer to settle the situation.
A first reminder may be sent to the Customer.
If the situation is not settled, or no reply is received, within 15 days, Gustosia may restrict access to the account and to the service’s features.
A second reminder may then be sent to the Customer.
If the situation is still not settled despite these steps, Gustosia may suspend or block the account.
Suspending or blocking the service does not constitute a waiver of the sums owed by the Customer.
Sums corresponding to a subscription period during which the contract remains in force remain payable, subject to the applicable provisions and the Customer’s contractual situation.
If a debt remains unpaid, Gustosia may take any appropriate recovery action, in particular a formal notice and, if necessary, judicial recovery proceedings.
12. Late payment penalties
Any late payment automatically, and without any reminder being necessary, gives rise to late payment penalties, payable from the day after the payment date shown on the invoice.
Unless a valid contractual provision sets a different rate within the legal limits, the late payment penalty rate is equal to the rate applied by the European Central Bank to its most recent refinancing operation, plus ten percentage points, in accordance with Article L.441-10 of the French Code de commerce (Commercial Code). This rate may not be lower than the applicable legal minimum.
In accordance with the provisions applicable between professionals, a fixed indemnity of €40 for recovery costs is due for any late payment.
Where the recovery costs incurred exceed the amount of this fixed indemnity, additional compensation may be claimed upon proof.
13. Access to the service and availability
Gustosia implements the reasonable means necessary to ensure the accessibility and proper functioning of the service.
However, Gustosia does not guarantee permanent and uninterrupted availability of the service.
The service may in particular be temporarily unavailable due to:
- maintenance operations;
- updates;
- technical interventions;
- failures of technical infrastructure;
- network or connection problems;
- failures or unavailability of third-party services;
- a force majeure event or an event beyond Gustosia’s control.
Where reasonably possible, Gustosia endeavours to limit the duration of interruptions and to inform Customers of maintenance operations likely to significantly affect the service.
14. Hosting and third-party technical services
The Gustosia application is hosted on technical infrastructure dedicated to the operation of the service.
Application data may in particular be stored or processed by means of third-party technical services used by Gustosia, including Supabase for the database and Stripe for payment management.
Messages sent by visitors using the contact form on the gustosia.com website are forwarded to Gustosia via the Web3Forms service.
The sending of certain emails related to user accounts, including email address verification and password reset emails, is handled through the provider Brevo. Information about this processing is set out in the Privacy Policy.
15. Ownership of the Customer’s content
The Customer remains the owner of the content they provide to Gustosia, in particular their texts, photographs, logos, set menus, menus, prices and visual identity elements.
The Customer guarantees that they hold the rights needed to provide this content to Gustosia and to allow its use as part of the service.
The Customer authorises Gustosia, for the duration of the contractual relationship, to reproduce, host, technically adapt and display this content to the extent necessary to provide the service subscribed to.
This authorisation is limited to the provision, operation and maintenance of the Gustosia service.
16. Gustosia’s intellectual property
The elements developed or made available by Gustosia as part of the service, in particular the application, interfaces, code, features, structures, graphic elements, logos, designs, texts and tools, remain the property of Gustosia or of their respective owners.
The Customer has a right to use the service for the duration of their subscription and within the limits of the plan subscribed to.
In particular, the Customer shall not:
- reproduce or copy the service;
- attempt to extract its source code;
- resell or sublicense the service;
- use the service to develop a competing service based on its protected elements;
- circumvent technical security or access control measures.
17. Customer’s liability
The Customer is responsible for the use they make of their account and of the information accessible from it.
In particular, the Customer undertakes to:
- keep their login details confidential;
- not disclose their access details to unauthorised persons;
- inform Gustosia in the event of suspected unauthorised access;
- provide accurate and up-to-date information;
- regularly check the information published on their menu or guide;
- comply with the regulations applicable to their business.
The Customer remains solely responsible for the information presented to their own customers and users.
Gustosia provides a content publishing and management tool and is not involved in the commercial operation of the Customer’s establishment.
18. Gustosia’s liability
Gustosia undertakes to provide the service diligently and in accordance with the features presented for the plan subscribed to.
In particular, Gustosia cannot be held responsible for:
- incorrect or incomplete information provided by the Customer;
- the consequences of misuse of the service;
- damage resulting from the use or display of content provided by the Customer;
- unavailability resulting from third-party services or circumstances beyond its control;
- interruptions needed for the maintenance or security of the service;
- indirect damage resulting from the use of the service.
The limitations of liability set out in this article do not apply where the law prohibits such a limitation.
19. Personal data
Gustosia processes the personal data needed for the creation, management and operation of customer accounts and of the service.
The arrangements for collecting, using, storing and protecting personal data, as well as the arrangements for data subjects to exercise their rights, are set out in the Privacy and Personal Data Protection Policy available on the gustosia.com website.
Where Gustosia processes personal data on behalf of the Customer as part of the use of the service, the respective roles of the parties and the applicable obligations are defined in the appropriate contractual documentation, in accordance with the applicable data protection regulations.
20. Force majeure
Gustosia cannot be held responsible for a failure to fulfil its obligations where this results from an event reasonably beyond its control and meeting the conditions of force majeure provided for by the applicable law.
This may include, in particular, events affecting telecommunications networks, hosting infrastructure, third-party services, natural disasters, fires, major breakdowns, malicious acts, industrial action, administrative decisions or similar events temporarily preventing the normal performance of the service.
21. Changes to the service
Gustosia may change its features, interface, technical infrastructure or certain elements of the service in order to improve it, secure it, maintain it or adapt it to technical and regulatory developments.
These changes must not have the effect of removing, without justification, access to the essential features of the plan subscribed to during the current subscription period.
22. Changes to the T&Cs
Gustosia may amend these T&Cs to take account, in particular, of changes to the service, its plans or the applicable regulations.
Any change applicable to an ongoing contractual relationship will be brought to the Customer’s attention within a reasonable period before it takes effect, subject to the applicable statutory provisions.
The applicable version and the arrangements for changes to take effect are determined in accordance with the applicable statutory and contractual provisions.
The date of the last update is shown at the top of these T&Cs.
23. Applicable law, amicable settlement, alternative dispute resolution and competent court
These T&Cs are governed by French law.
In the event of a dispute relating to the formation, interpretation, performance or termination of the contract, the parties will first endeavour to find an amicable solution through direct discussion conducted in good faith.
If the dispute cannot be resolved amicably, the parties may agree to use an alternative dispute resolution (ADR) method, in particular mediation or contractual conciliation, under arrangements defined by mutual agreement.
Failing an amicable resolution or settlement through an ADR method, the dispute will be brought before the court having subject-matter and territorial jurisdiction in accordance with the applicable statutory rules.
Where the conditions of validity of the jurisdiction clause laid down in Article 48 of the French Code de procédure civile (Code of Civil Procedure) are met, in particular where all the parties entered into the contract as traders (commerçants, within the meaning of French law), the Tribunal mixte de commerce (mixed commercial court) of Saint-Denis, La Réunion, will have jurisdiction to hear the dispute. This jurisdiction clause is prominently displayed in the contractual terms to which it applies.
24. Acceptance of the T&Cs
Subscribing to a Gustosia plan implies that the Customer acknowledges having read these T&Cs and accepts them without reservation.
These T&Cs constitute the contractual framework applicable to the provision of the Gustosia service, subject to any specific conditions agreed in writing between the parties.
